1. Contest Period: The Yard-Machines "Hardest Working Dad" Contest ("Contest") begins at 10:00 a.m. Eastern Time ("ET") on April 17, 2008 and ends at 11:59 p.m. ET on May 28, 2008 (the "Contest Period").
2. Two Ways To Enter: (1) Visit www.homedepot.com/sweepstakes ("Entry Site") during the Contest Period, click the Hardest Working Dad Contest link and fill in all required information for yourself and your nominee, including: submitting an essay (in English), in 75 words or less, describing the hardest working dad you know ("Entry"). You (hereinafter "nominator") may nominate any dad (whether it's you, your dad, or a hardworking dad you know) (hereinafter "nominee"). (2) Official Entry Forms will be available at participating The Home Depot retail stores from April 17, 2008 through May 28, 2008, or while supplies last. Mail your completed entry with all Entry components as stated above, in a hand-addressed, stamped envelope, to: The Home Depot - Yard Machines Hardest Working Dad Contest, P.O. Box 7872, Melville, NY, 11775-7872. All mail-in entries must be postmarked by May 28, 2008 and received by June 4, 2008, to be eligible for the drawing/judging. You must include your return address on your mailed envelope. Limit one unique mail in entry per envelope. Mechanically reproduced mail-in or deposited entries are void. All entries must be complete to be eligible. All entries become property of the Sponsor and will not be returned.
3. Entry Requirements: The Entry must be in keeping with Sponsor's image and may not contain obscene, lewd or inappropriate text, as determined in Sponsor's sole discretion. If you are not nominating yourself, you must notify the nominee to let him know you are entering on his behalf. Any Entry or portion thereof that is, in the Sponsor's sole discretion, obscene, profane, lewd, defamatory, contains any third party materials, or otherwise violates or infringes (or may infringe) any copyright, trademark, logo, mark that identifies a brand or other proprietary right of any person living or deceased (including but not limited to rights of privacy or publicity or portrayal in a false light) or entity, or is otherwise objectionable, will not be considered and may disqualify the nominator. Nominators may not copy or otherwise plagiarize the Entry from any source. All Entries must be the sole, original work of the nominators. Sponsor may disqualify previously published essays or essays that have won previous awards or competitions. Entries become the property of the Sponsor and will not be acknowledged or returned. Nominators acknowledge and agree that their Entries become the property of the Sponsor, which thereby has the right to edit, adapt, modify, reproduce, promote and otherwise use Entries in any way it sees fit. Automated, script, macro or robotic Entries submitted by individuals or organizations will be disqualified. Any Entry not in compliance with the above and does not meet the Sites' requirements will be disqualified. By entering, you agree to waive any rights you may have to the Entry submitted.
4. Eligibility: Nominators must be legal residents of the 50 United States or the District of Columbia, who are 18 years of age or older as of date of Entry. Nominees must be legal residents of the 50 United States or the District of Columbia, who are males and are fathers/legal guardians, 18 years of age or older. Employees of MTD Consumer Group Inc, Home Depot U.S.A., Inc., Don Jagoda Associates, Inc., their respective affiliates, parents, subsidiaries, divisions, suppliers, distributors and advertising, promotional and judging agencies (collectively "Sponsor and its Administrators"), and its affiliates and each of their respective employees, shareholders, directors, officers, members and agents and their immediate family members and/or those living in the same household of each are not eligible to participate or win.
5. Prizes and Approximate Retail Values ("ARV"): Grand Prize (1): A $500 The Home Depot Gift Card and the following YARD-MACHINES products: [13AN772G029, 11A-54MB029, 25B-5500029, 31A-3CAD729, OHD-190-180, OEM-190-607]. ARV: $3,000. First Prize (7, 1 per each of the following regions): [South East, North East, Mid West, South West, North West, Alaska, Hawaii] A $500 The Home Depot Gift Card and a YARD-MACHINE of winner's choice [11A-08MA029, 11A-41MB029, 11A-54MB029, 25B-5500029, 24A-452G729, 31AS231-729, 31A-3CAD729], valued at $500 or less (ARV: $1000 each). Total ARV of all prizes: $10,000. Prizes will be awarded to the nominee. Prizes will be awarded and nominees will be notified by phone/mail. Gift card subject to expiration date and additional restrictions may apply. Gift Cards are subject to terms and conditions on the back of each card and as otherwise specified by The Home Depot. Prizes are not transferable or redeemable for cash and no substitutions are allowed, except by Sponsor who reserves the right to substitute a prize of comparable or greater value, at its sole discretion. Winners may use The Home Depot Gift Card toward the purchase of merchandise at any The Home Depot retail store or EXPO Design Center. The Home Depot Gift Card has no implied warranties, is not a credit card or debit card, and is redeemable for merchandise only and will not be redeemed or exchanged for cash, check or credit. It may not be used for payment on any credit or loan account. 6. Finalist Random Drawings: In the event that more that 100 eligible Entries are received per region (based on nominee's mailing address), one hundred (100) Finalists per region will be selected in separate random drawings (to be judged) on or about June 9, 2008, from among all eligible Entries received per region. The random drawings will be conducted by Don Jagoda Associates, Inc., an independent judging organization whose decisions are final on all matters relating to the Contest. Odds of being selected as a Finalist will depend upon the total number of eligible Entries received per region.
7. Grand and First Prize Judging: The 100 Finalists randomly chosen in each region will be judged to determine the Grand and First Prize winners. The judging will occur on or about June 11, 2008, under the supervision of the Sponsor, based on the following judging criteria: Best depiction of Hardest Working Dad - 50%; Uniqueness - 25%; and Creativity - 25%. In the event of a tie, tied Entries will be re-judged based solely on Best depiction of Hardest Working Dad, to determine the winners. In the event there are 100 or fewer Entries received per region, all eligible Entries will be judged as described above.
8. General Rules: Potential nominators and corresponding Grand Prize and First Prize Winners (or parent/legal guardian if a winner is a minor in his/her state of residence) will be required to sign and return an Affidavit of Eligibility, liability/publicity release (except where prohibited by law) and assignment of rights within ten (10) days (including weekends) of notification attempt or the prize will be forfeited and alternate winner may be determined. Affidavit package will be mailed to nominators/winners or sent via email. Return of prize or prize notification as undeliverable may result in disqualification and alternate determination. No substitution or transfer of prize permitted except at the sole discretion of the Sponsor who reserves the right to substitute a prize (or portion of prize) of equal or greater value in the event the prize is unavailable. All federal, state and local taxes are the sole responsibility of winner (or the parent/guardian if winner is a minor in his/her state of residence), if applicable. Winners and all corresponding nominators, as a condition of Entry into the Contest, agree to release Sponsor and its Administrators, each of their respective agencies, parents, subsidiaries, affiliated companies and each of their respective officers, directors, shareholders, members, employees, agents, assigns, and all others associated with the development and execution of this Contest (collectively the "Released Parties") from and against any and all liability, claims or actions of any kind whatsoever for injuries, damages, or losses to persons or property which may be sustained in connection with submitting an Entry or otherwise participating in any aspect of the Contest, the receipt, ownership or use of prize awarded or any typographical or other error in these Official Rules or the announcement of offering of the prizes. Acceptance of prize constitutes permission to use winner's/nominator's name, likeness, and essay as applicable for promotional purposes (including any possible public relations opportunities) without further compensation except where prohibited by law. By entering, nominator accepts and agrees to be bound by these Official Rules. Online Entries will be declared to be made by the authorized account holder of the e-mail address submitted at the time of Entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet Access provider, Online Service provider, or other organization (e.g., business, educational institution etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Sponsor reserves the right at its sole discretion to disqualify any individual that tampers or attempts to tamper with the Entry process or the operation of the Contest or the Site; violates the Official Rules; acts in an unsportsmanlike or disruptive manner; or acts with intent to annoy, abuse, threaten or harass any other person. The Released Parties are not responsible for incomplete, illegible, misdirected, damaged, lost, postage due or late mailed entries or for technical, hardware or software malfunctions, telephone failures of any kind, lost or unavailable network connections, or failed, incorrect, inaccurate, incomplete, garbled or delayed electronic communications, whether caused by the sender, by any of the equipment or programming associated with or utilized in this Contest which may limit the ability to participate, or by any human error which may occur in the processing of the Entries in this Contest. Sponsor reserves the right to cancel, terminate or modify the online portion of the promotion if it cannot be completed as planned for any reason, including for infection by computer virus, bugs, tampering, unauthorized intervention, technical failures or corruption of any sort. In such event, Sponsor will conduct judging from eligible online Entries received prior to cancellation and all eligible mailed entries received. As a condition of entering the Contest, nominator (or parent/legal guardian if nominator is a minor in his/her state of residence) agrees that: 1) under no circumstance will nominator be permitted to obtain awards for, and participant hereby waives all rights to claim, punitive, incidental, consequential or any other damages, other than for out-of-pocket expenses; 2) all causes of action arising out of or connected with this Contest, or any prize awarded, shall be resolved individually, without resort to any form of class action; and 3) any and all claims, judgments, and award shall be limited to actual out-of-pocket costs incurred, but in no event attorneys fees.

9. Conditions: Nominator shall have no right to review or approve edits, alterations or modifications, and the nominator waives the benefit of any provision of law known as "moral rights". No information regarding Entries or judging will be disclosed to any third party not involved in the conduct of the Contest. By submitting an Entry, you as the nominator, represent: (a) that the Entry is your own original work that has not previously been published or publicly shown or won a prize or award; and (b) any and all rights to the Entry belong to you and the Entry does not infringe, misappropriate or violate the rights of any third party. Further, any Entries that Sponsor, in its sole discretion, deems to be inappropriate for publication will not be considered.
10. Choice Of Law: Under no circumstances will entrants be permitted to obtain awards for, and entrants hereby waive all rights to claim, punitive, incidental or consequential damages, or any other damages, including attorneys' fees, and entrants further waive all rights to have damages multiplied or increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrants and Sponsor in connection with this Sweepstakes, shall be governed by, and construed in accordance with, the substantive laws of the State of Georgia, without regard to Georgia conflict of law principles.
